Terms of Service
These terms govern your school or district's access to and use of the SchoolBanks platform. By using SchoolBanks, you agree to the terms below.

1. Agreement to Terms
These Terms of Service ("Terms") are a binding agreement between SchoolBanks, Inc. ("SchoolBanks," "we," "us") and the school, district, or organization that creates an account or signs an order form for the SchoolBanks platform ("Customer," "you"). If you access or use the platform, you agree to these Terms.
2. The Service
SchoolBanks provides a K-12 financial operations platform covering fee management, payments, asset tracking, reporting, and related accounting workflows ("Service"). Where a signed order form, master services agreement, or data processing agreement exists between SchoolBanks and Customer, that document controls to the extent it conflicts with these Terms.
3. Accounts and Access
- Customer administrators are responsible for provisioning and de-provisioning user access within their organization.
- Account credentials may not be shared, and each user is responsible for activity under their own login.
- Customer must notify SchoolBanks promptly of any suspected unauthorized access.
4. Payments and Fees
Subscription fees, transaction fees, and any processing fee configurations are set out in the applicable order form. Fees are non-refundable except as required by law or expressly stated in the order form.
5. Customer Data
Customer retains ownership of all data it submits to the Service, including student, family, and financial records ("Customer Data"). SchoolBanks processes Customer Data only to provide, maintain, and improve the Service, consistent with our Privacy & Data Handling commitments and any applicable data processing agreement.
6. Acceptable Use
Customer will not, and will not permit others to: reverse engineer the Service; use the Service to store or transmit unlawful content; attempt to bypass security controls; or use the Service in a way that violates applicable student privacy laws, including FERPA.
7. Availability and Support
SchoolBanks will use commercially reasonable efforts to keep the Service available, subject to scheduled maintenance and factors outside our control. Support is available through the SchoolBanks Support Portal.
8. Term and Termination
These Terms remain in effect for as long as Customer maintains an active subscription. Either party may terminate for the other party's uncured material breach. Upon termination, SchoolBanks will make Customer Data available for export for a reasonable period, consistent with our Retention & Deletion practices.
9. Warranties and Disclaimers
Except as expressly stated in an order form or master services agreement, the Service is provided "as is." SchoolBanks disclaims all other warranties, express or implied, to the maximum extent permitted by law.
10. Limitation of Liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, or consequential damages, and each party's total liability arising from these Terms will not exceed the amounts paid by Customer to SchoolBanks in the twelve months preceding the claim, except where a signed agreement between the parties provides otherwise.
11. Changes to These Terms
SchoolBanks may update these Terms from time to time. Material changes will be communicated to Customer administrators, and continued use of the Service after changes take effect constitutes acceptance.
